MD HB 567 / SB 541 (2024)Online Data Privacy Act (MODPA)
One of the nation's strictest data minimization laws. Businesses may only collect personal data that is 'reasonably necessary' for a disclosed and legitimate purpose. Prohibits data processing that would discriminate against individuals based on sensitive attributes. Includes heightened protections for children's data and requires data protection impact assessments for high-risk processing.
— Maryland's MODPA is the toughest data minimization law in the country — 'reasonably necessary' is a higher bar than most states. Any platform touching MD resident data needs to audit its collection practices against legitimate purpose.
