SB 720 (2026RS)
Passed Senate 45-0 / House 129-8; enrolled April 13, 2026; effective June 1, 2026. Requires every local school system to adopt a board-approved AI policy aligned with MSDE guidance within 120 days of the guidance release; districts must designate an AI coordinator and align AI procurement with DoIT requirements. Policy must address privacy, procurement, academic integrity, and educator professional development. MSDE framework (Artificial Intelligence in K-12 Public Schools) presented to the State Board Feb 24, 2026; districts face a fall 2026 compliance window. AI Education Collaborative terminates May 31, 2028. UNVERIFIED (Jessica Maddry to clear): whether the 120-day clock runs from the Feb 24 State Board presentation or a distinct guidance publication date; enforcement mechanism and penalty (none identified — do not assert); exact signing date (reported May 26, 2026, not evidenced on the mgaleg page); scope over nonpublic schools receiving state funds. MD HB 567 / SB 541 (2024)
One of the nation's strictest data minimization laws. Businesses may only collect personal data that is 'reasonably necessary' for a disclosed and legitimate purpose. Prohibits data processing that would discriminate against individuals based on sensitive attributes. Includes heightened protections for children's data and requires data protection impact assessments for high-risk processing.
